Scale Collaborative maintains this website, any hosted learning content, online forums, coaching services and other linked and related sites (the “Site”) for the use of its customers, vendors, partners, students, and other Site participants (“Users”) upon agreement to the following terms.
Please read these terms and our privacy policy carefully before using the Site. Use of this website indicates acceptance of these “Terms of Use” and forms a binding agreement between you and Scale Collaborative. If you do not agree to these terms, do not use this Site.
1. Use of Site
Scale Collaborative provides various learning content, online forums, coaching services, quizzes, questions, articles, news and other information on this and related sites (the “Materials”). Scale Collaborative authorizes each User to view the Materials. Where some of the Materials are available for download by the User, a reasonable number of copies of the Materials may be printed provided that Users make no modifications to the Materials and you retain all copyright and other proprietary notices contained in the original Materials on any copies of the Materials.
Users may not modify the Materials at this Site in any way or reproduce, share or distribute them beyond the purpose of personal learning and development. Users will keep all Materials confidential, and will not sell, auction, loan, rent, give away, describe, summarize, or otherwise reveal the Materials or their contents, to any other person or entity beyond the purpose of personal learning and development. Any breach of these Terms of Use automatically terminates your authorized use of the Site.
2. User Warranty
As a User you warrant that you are not accessing the Materials as an agent or employee of any other learning content company and will use the Site and Materials solely for the purpose of personal learning and development.
3. No Transfer of Intellectual Property
Users acknowledge that Scale Collaborative is the owner of the Intellectual Property Rights of the Materials and all rights associated therewith. Materials include, but are not limited to online learning content (lessons, videos, worksheets, presentations, exercises, quizzes, case studies and other activities). Users acknowledge that they shall not use, acquire, or claim any right, title, or interest in the Materials without previously obtaining the written permission of Scale Enterprises Ltd. With prior permission granted, participants will acknowledge Scale Collaborative on all approved usage of Materials.
4. Trademark and Copyright
Thriving Non-Profits, and certain other brands, trademarks, and service marks are marks of Scale Collaborative and its affiliates. The Materials on this Site are copyrighted, and any unauthorized use of any Materials on this Site may violate copyright, trademark, and other laws.
5. Hyperlinks
Links to external websites are provided solely as a convenience to you. Scale Collaborative has not reviewed all of these external websites, does not control and is not responsible for any of these sites or their content. If you decide to access any of the external websites linked to this Site, you do so entirely at your own risk.
6. No Warranty
The Materials provided at this site are provided “as is” without any warranties of any kind including warranties of merchantability, fitness for a particular purpose, or non-infringement of intellectual property. Scale Collaborative further does not warrant the accuracy and completeness of the Materials at this Site. Scale Collaborative may make changes to the Materials at this Site, or to the services and prices described in them, at any time without notice. The Materials at this Site may be out of date, and Scale Collaborative makes no commitment to update the Materials at this Site.
7. Limitation of Liability
Materials are provided solely for information. Each jurisdiction has laws and regulations that may affect the implementation of specific strategies or ideas described in the Materials. Participants are advised to seek legal advice before implementing any of the strategies covered in the Materials.
In no event will Scale Collaborative its suppliers, or other third parties mentioned at this Site be liable for any damages whatsoever arising out of the use, inability to use, or the results of the use of this Site, any websites linked to this Site, or the Materials or information contained at any or all such sites, whether based on warranty, contract, tort or any other legal theory and whether or not advised of the possibility of such damages. If your use of the Materials or information from this Site results in the need for servicing, repair or correction of equipment or data, you assume all costs thereof.
8. Applicable Law
The Terms of Use are governed by the laws of the province of British Columbia, Canada. Failure to enforce strict performance of the Terms of Use of Use shall not be construed as a waiver of any provision or right. Scale Collaborative may assign its rights and duties under the Terms of Use without notice to any party at any time.
9. Effective Date and Updates
The Terms are effective as of April 3, 2023 and are subject to change without notice by Scale Collaborative at any time. Please check for changes regularly. Your use of this Site after such changes constitutes your agreement to such changes.
10. Refund Policy
We want you to be happy with the products, services, and subscriptions that you purchase at www.thrivingnonprofits.ca. Therefore, if you find that your experience does not meet your expectations, you may request a refund within seven days of your original purchase date. In the case of our Thriving Non-Profits coaching services, refund requests must be received within seven days of the date that the coaching service was delivered.
Exceptions: In the case of monthly or annual recurring charges related to our subscription services, we are only able to issue a refund for the most recent payment. For example, if you have an active monthly or annual subscription to the Thriving Non-Profits Community, you may request a refund of your most recent payment within seven days of the payment date.
Please note: All qualifying refunds will be processed as quickly as possible, however, we appreciate your understanding that funds may take several business days to return to your account.
How to request a refund: Refunds must be requested in writing by sending an email to [email protected]. All refunds must meet the criteria set out in our refund policy above for each respective product, service or subscription type. If possible, please include the reason you are requesting a refund, as this may help us to improve our products and services.
